1. Acceptance of Terms
These Terms & Conditions ("Terms," "Agreement") are between you and Davopay ("we," "our," or "us"). They govern your access to and use of the Davopay website, mobile application, and related services (collectively, the "Platform").
By registering for or using the Platform, you unconditionally accept these Terms. If you do not agree, please do not use the Platform. We may revise these Terms from time to time; where a change materially affects your rights or obligations, we will make reasonable efforts to notify you (for example, by email or in-app notice) before it takes effect. Your continued use of the Platform after a revision takes effect constitutes acceptance of it.
Davopay is a financial technology company, not a bank. The regulated financial functions behind our Services, Bill payments, card issuance, payment processing are provided by our licensed and regulated partners.
2. Our Products and Services
Davopay provides:
- USD Virtual Cards b virtual dollar cards for online shopping, subscriptions, and international payments.
- Gift Card Trading b exchanging eligible gift cards for cash at rates displayed on the Platform.
- Bill Payments b paying for airtime, data, and utility bills through the Platform.
- Money Transfers b sending and receiving money.
We may add, modify, or discontinue features at our discretion, with reasonable notice where a change affects funds or transactions you've already initiated.
3. Eligibility
To use the Platform, you must:
a) Be at least 18 years old, and if using the Platform on behalf of a business, have the authority to bind that business to this Agreement; b) Complete our registration and identity verification process; c) Not have been previously suspended or banned from the Platform; d) Not be barred from using financial services under any law applicable to you, including anti-money laundering, counter-terrorism financing, and sanctions regulations; and e) Provide accurate, current, and complete information, and keep it updated.
4. Account Registration and Identity Verification
Opening a Davopay account requires identity verification in line with know-your-customer ("KYC") requirements. Identity verification is carried out on our behalf by Dojah, our identity verification and AML compliance partner. By registering, you authorize Davopay and Dojah to verify your identity, including your BVN, NIN, and government-issued ID directly or through public and private data sources, and to take any action reasonably necessary based on the results, including declining or limiting your account.
5. Account Security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Davopay will never ask for your password, PIN, or one-time passcode by phone, email, or social media. Notify us immediately at support@davopay.com if you suspect unauthorized access to your account. Davopay is not liable for losses arising from your failure to keep your credentials secure, except where the loss results from our own negligence or breach of these Terms.
6. USD Virtual Cards
- Cards are issued and processed through our licensed card issuance partner.
- Funds loaded to a card must come from a source you legitimately control. We may decline, delay, or reverse a funding request that fails our verification or fraud checks.
- Cards may be subject to limits on funding amount, transaction amount, or merchant category, which will be displayed on the Platform and may change from time to time.
- We are not responsible for a merchant's refusal to accept the card, for pricing or currency-conversion practices of merchants or card networks, or for a merchant's failure to deliver goods or services you paid for with the card.
- We may freeze, suspend, or close a card where we reasonably suspect fraud, a prohibited transaction, or a breach of these Terms.
7. Gift Card Trading
This section governs the sale of gift cards to Davopay in exchange for cash ("Gift Card Trades").
7.1 Ownership and Legitimacy. By submitting a gift card for trade, you represent and warrant that you are the lawful owner of the card, that it was legitimately obtained (for example, purchased, received as a genuine gift, or earned through a legitimate reward program), and that you have the right to sell it. You must not submit a gift card that was stolen, obtained through fraud, phishing, or a scam, or acquired in violation of the card issuer's own terms. Davopay may decline any trade, and may report the transaction to the relevant authorities, where we reasonably suspect a card was not legitimately obtained.
7.2 How Trades Work. You select a gift card category, enter the required details (which may include the card code, PIN, and for certain cards or higher-value rate categories a purchase receipt), and receive a displayed rate. Rates vary by brand, denomination, receipt category, and current market demand, and can change at any time before you confirm a trade. Once you confirm a trade, the rate for that specific submission is locked in, subject to successful verification under Section 8.3.
7.3 Verification and Payment. Every submitted card is verified before payment is released. Payment is based on the verified balance actually available on the card, not the face value printed on it or claimed at submission some cards (particularly certain Visa/Mastercard prepaid cards) carry activation fees or prior partial usage that reduce the usable balance below face value. Verification can result in one of the following outcomes:
- Full approval b the card is valid and the full submitted balance is confirmed; you are paid at the agreed rate.
- Partial approval b only part of the submitted balance is confirmed (for example, the card was partially used); we will offer payment for the verified portion only, and you will be notified of the adjustment before payment.
- Rejection b the card cannot be processed. A rejected trade will not be paid. Reasons for rejection include, without limitation:
- The card has already been redeemed or has a zero balance;
- The code or PIN is invalid, incomplete, or unreadable;
- The card is locked, on hold, flagged as lost or stolen, or reported to the issuing brand;
- The card is region-locked, expired, or not currently supported on the Platform;
- The card is tied to an account or identity other than yours, where the brand requires such a match;
- A required receipt is missing, does not match the card, or is otherwise invalid;
- We reasonably suspect the card was fraudulently obtained or is linked to prohibited activity.
Where a trade is rejected or adjusted, we will state the reason in-app. Rejection or a lower verified balance does not by itself mean you are accused of wrongdoing. most rejections come down to the card's own status (already used, on hold, incorrectly entered) rather than anything you did. Where we do suspect fraud specifically, that will also be stated, and you may be asked for further information.
7.4 Card Codes and Confidentiality. Once you submit a card code or PIN for trade, treat it as spent do not attempt to use or resell it elsewhere, and do not share it with anyone besides Davopay. Submitting the same card code to more than one platform, or attempting to use a card after submitting it for trade, is a breach of these Terms and may result in account suspension.
7.5 Denomination and Volume Limits. Certain gift card brands or categories may carry minimum or maximum denomination limits, or limits on the number of cards you can submit in a given period. These will be displayed on the Platform and may change based on market conditions.
7.6 Disputes. If you believe a rejection or partial-approval decision was made in error, contact support@davopay.com with your transaction reference. We will review the verification result and respond with an explanation or a corrected outcome.
8. Money Transfers
- Transfers are processed through our regulated payment partners.
- You are responsible for the accuracy of recipient details you provide. Davopay is not liable for a transfer sent to an incorrect recipient because of details you supplied incorrectly, though we will make reasonable efforts to assist in recovering the funds.
- Transfers may be delayed or declined for verification, fraud-prevention, or compliance reasons.
- We may request for additional informations when needed.
9. Bill Payments
- Bill Payments let you pay for airtime, data bundles, and utility bills (such as electricity or TV subscriptions) through the Platform.
- You are responsible for entering the correct biller, account number, meter number, or phone number. Davopay is not liable for a payment that fails to reach its intended destination because of incorrect details you supplied, though we will make reasonable efforts to assist in resolving it with the biller.
- Once a bill payment has been successfully submitted to the biller, it is generally final and cannot be reversed or refunded through Davopay.
- Davopay acts as a payment intermediary for these services and is not responsible for a biller's own service delivery, for example, a delay in activating a subscription or crediting a meter once payment has been confirmed as sent.
- Payment confirmation is provided in-app once a transaction is successfully processed.
10. Fees and Rates
Applicable fees, exchange rates, and gift card rates are displayed on the Platform before you confirm a transaction. Rates and fees may change at any time; the rate shown at the time you confirm a transaction is the rate that applies to that transaction.
11. Transaction Cancellation and Modification
- You may be able to cancel a transaction within a limited window after initiating it; this window depends on the transaction type and its processing stage, and is not guaranteed once processing has begun.
- We may cancel or decline a transaction that appears suspicious, that we believe exceeds our risk appetite, or for which you have not supplied information we reasonably require (such as a purchase receipt).
- We may correct a transaction submitted with incorrect details, and will notify you of any such correction.
12. Prohibited Activities
You must not, in connection with the Platform:
a) Breach these Terms or our Privacy Policy;
b) Submit or trade any asset including a gift card, card balance, or cryptocurrency that was not legitimately obtained by you;
c) Engage in or facilitate fraud, money laundering, terrorism financing, or sanctions evasion;
d) Provide false, misleading, or incomplete information during registration, verification, or any transaction;
e) Attempt to circumvent our verification, fraud-detection, or security measures;
f) Use the Platform in a manner that violates any law applicable to you; or
g) Interfere with the Platform's operation, including through automated access that places unreasonable load on our systems.
We may restrict, suspend, or terminate your access, and take any other lawful action, where we reasonably suspect any of the above.
13. Account Monitoring, Suspension, and Termination
We may suspend, limit, or close your account where we have reasonable cause to believe that:
a) You have violated these Terms;
b) Your use of the Platform is fraudulent, unlawful, or contrary to the purpose of this Agreement;
c) You have supplied false or misleading information at registration, verification, or during a transaction;
d) You have not responded to a request for information within a reasonable time; or
e) We are required to act under applicable law, regulation, or an order of a competent authority.
Where practical, we will notify you of the action taken and, where applicable, the reason.
14. Intellectual Property
Davopay owns all intellectual property in the Platform, including its software, design, logos, and trade names, except for third-party marks that remain the property of their respective owners. These Terms do not grant you any ownership interest in the Platform or license to use our marks beyond what is necessary to use the Services as intended.
15. Disclaimers and Limitation of Liability
- The Platform is provided "as is." We do not guarantee that it will be uninterrupted, error-free, or available at all times.
- Davopay is not liable for delays or failures caused by events outside our reasonable control, including internet or network outages, regulatory action, or third-party service failures (including those of our card, payment, or identity-verification partners).
- To the fullest extent permitted by law, Davopay disclaims liability for indirect, incidental, or consequential damages arising from your use of the Platform.
- Nothing in this section limits liability that cannot be excluded under applicable law, including liability for our own fraud or gross negligence.
16. Anti-Money Laundering and Compliance
Davopay maintains a compliance program addressing anti-money laundering ("AML"), counter-terrorism financing, and sanctions obligations applicable to our Services in Nigeria, including transaction monitoring, KYC verification, and reporting to competent authorities where legally required. We may request additional information or documentation at any time to meet these obligations, and may delay, decline, or reverse a transaction while we do so.
17. Dispute Resolution and Grievances
If you have a complaint, contact us at support@davopay.com We aim to acknowledge complaints promptly and resolve them fairly. Support requests are only recognized through the official channels listed here or on the Platform we are not responsible for interactions through unofficial or unverified channels claiming to represent Davopay.
18. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
19. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Where a change materially affects your rights or obligations, we will make reasonable efforts to notify you before it takes effect.
20. Force Majeure
Davopay is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, strikes, governmental action, or internet or telecommunications failures.
